CONDITIONS OF SALE
These terms and conditions help to keep the timetrek.co.uk website a safe place to trade and set out the full extent of any agreement reached between you and timetrek.co.uk in connection with this site. You should understand that by placing an order, you accept the following terms and conditions:
1. You agree that e-mail can be used as a long-distance means of communication.
2. No contract for the sale of any product will subsist between you and timetrek.co.uk unless and until timetrek.co.uk accepts your order by way of an e-mail confirming that it has received payment in full for all the goods you have ordered. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time timetrek.co.uk sends the e-mail to you (whether or not you receive that e-mail). This confirmation e-mail amounts to an acceptance by timetrek.co.uk of your offer to buy goods from timetrek.co.uk or a 3rd party supplier that is engaged on your behalf by timetrek.co.uk.
3. The confirmatory e-mail will also contain a link to these terms and conditions.
4. You must check that the details on this confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it. This email will also be your only receipt (unless otherwise agreed upon via email). Please keep this email for your records.
5. Timetrek.co.uk will not pass on your personal details to any third party.
6. You undertake that all details you provide to timetrek.co.uk for the purpose of ordering or purchasing goods or services are correct, that the account you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.
7. If there are any changes to the details supplied by you it is your responsibility to inform timetrek.co.uk as soon as possible.
8. This Liability section applies only to the extent permitted by law. For the avoidance of doubt, timetrek.co.uk do not exclude or limit any liability for (a) personal injury (including sickness and death) where such injury results from timetrek.co.uks negligence or wilful default, or that of timetrek.co.uks employees, agents or subcontractors or (b) fraudulent misrepresentation.
9. Timetrek.co.uk does not accept liability (except as set out below) for any errors and omissions and reserves the right to change information, specifications and descriptions of listed goods, products and services.
10. Timetrek.co.uk will do its best to correct errors and omissions as quickly as practicable after being notified of them.
11. TO THE FULLEST EXTENT PERMITTED BY LAW, TIMETREK.CO.UK IS PROVIDING THIS WEB SITE AND ITS CONTENTS ON AN "AS IS" BASIS AND MAKES NO (AND EXPRESSLY DISCLAIMS ALL) REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THIS WEB SITE OR THE INFORMATION, CONTENT, MATERIALS OR PRODUCTS INCLUDED IN THIS SITE INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN ADDITION, TIMETREK.CO.UK DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ACCESSIBLE VIA THIS WEB SITE IS ACCURATE, COMPLETE OR CURRENT.
12. In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, timetrek.co.uk shall, at its own option, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question PROVIDED THAT you notify timetrek.co.uk of the problem via e-mail within 10 working days of delivery of the goods. Postage will not be refunded. Goods (unless defective) will not be refunded. NOTHING IN THIS CLAUSE AFFECTS YOUR STATUTORY RIGHTS.
13. Timetrek.co.uk does not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of or damage to property and/or loss from claims of third parties arising out of the use of the timetrek.co.uk website or for any products or services purchased from timetrek.co.uk.
14. Timetrek.co.uk will only be liable for direct loss up to a maximum total of the price of the product or service purchased in respect of any claim. Postage will not be refunded.
15. Title to any product ordered will pass to you once timetrek.co.uk has received payment in full for that product.
16. It is a crime to use a false name to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law.
Timetrek.co.uk may amend these terms and conditions from time to time, and place the new version on the website. When timetrek.co.uk do so, timetrek.co.uk will mention the fact on our home page (www.timetrek.co.uk). All purchases from the date that the amended terms are placed on our website onwards will be governed by those new terms.
17. These terms and conditions shall apply when timetrek.co.uk accepts your order by e-mail confirming that it has received payment in full for all the goods you have ordered. They shall supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between timetrek.co.uk and you relating to your purchase. Timetrek.co.uk advises that you print off and keep safe a copy of these terms and conditions once your order has been accepted by timetrek.co.uk.
18. You are advised to read (and are responsible for reading) all information on this website fully.
19. If any of these terms are held to be invalid or unenforceable, those terms will be struck out and the other terms remain.
20. Terms are strictly payment with order.
21. The goods will be dispatched by a reputable carrier and should arrive with you within 28 days of order (if the item is in stock and available). Times of delivery are estimated as accurately as possible but can be subject to delays out of our control and therefore we cannot be held responsible.
22. Any charges incurred from a debt recovery agency will be passed on to the customer.
23. In the case of non-delivery or missing parcels, normal channels will be pursued before replacement or compensation is allowed.
24. Deliveries must be checked by customers before signing receipt from carrier. The company will not be responsible for goods damaged in transit if signed for with no reference to condition delivered in.
25. Any damages or shortages must be notified in writing (either by post or email) within 1 day of receipt. Signed proof of carrier is required where complete parcel is damaged or there are shortages of items.
26. Ownership of goods is only passed to the purchaser when the full payment is received.
27. Where goods are lost, damaged or distorted after delivery, and the ownership has yet to pass, the purchaser will indemnify us against this loss provided it has not resulted from our negligence.
28. No return goods will be accepted unless previously agreed with Timetrek.co.uk. Returns under complaint must indicate invoice number and the Timetrek.co.uk reference number.
29. Refunds and exchanges can only be made for goods that are returned in the original packaging, unworn, unused and unwashed.
30. REFUNDS: Refunds will ONLY be given for damaged goods where no replacement product can be supplied. Abuse/misuse/incorrect ordering by the customer will NOT be refunded. Goods are not available for inspection or on approval basis. Refund will be via cheque & not refunded upon card used in purchase.
31. Timetrek.co.uk can take no responsibility for goods incorrectly ordered.
32. All other refunds will be liable for an administration charge of 10% of the total invoice price.
33. All goods are subject to guarantee against faulty manufacture and defective materials. Goods will be exchanged or credit note or monies returned only if goods are returned to us in good condition and not suffering from damage due to misuse or excessive wear. This clause does not affect your statutory rights.
34. Description and prices are correct at the time of going to the press but many are subject to alteration. We reserve the right to invoice at prices ruling at the time of despatch. Every effort will be made to notify customers of price increase prior to despatch.
35. Goods are offered subject to availability.
36. We do not accept liability for damage or injury caused through misuse of products purchased.
37. All retail prices are inclusive of VAT. Childrens clothing and printed materials are zero rated for VAT. VAT is charged at the rate applicable at the time of purchase. Postage and Packing also incurs VAT charges.
38. The actual products may differ from the photographs shown on this website as pictures are for illustration purpose only.
39. These terms supersede all previous business agreements.
40. Orders outside of the UK are subject to different rates of postage. You be advised of such postage before the confirmation of sale.
41. Timetrek.co.uk do not accept responsibility for online fraud subject to persons while using the website. Every effort has been made to combat this to this effect.
